This website is operated by Algoritmo Espacial, Unipessoal Lda., under the brand IQUI.
All artworks presented on this website are original works created by Joana Castro, the artist.
Throughout the site, the terms "we", "us" and "our" refer to Algoritmo Espacial, Unipessoal Lda. as the commercial entity responsible for sales, payments, and fulfillment.
By visiting our site and purchasing from us, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including those additional terms and policies referenced herein and available by hyperlink. These Terms apply to all users of the site, including browsers, customers, and contributors of content.
We reserve the right to update or modify these Terms at any time by posting changes to this page. Your continued use of the site following any updates constitutes acceptance of those changes.
SECTION 1 – ONLINE STORE TERMS
By agreeing to these Terms, you represent that you are at least the age of majority in your country of residence, or that you have the consent of a legal guardian to use this site.
You may not use our products for any unlawful or unauthorized purpose. Any breach of these Terms may result in immediate termination of access.
SECTION 2 – GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including payment information) may be transferred unencrypted across networks.
Payment information is always encrypted and securely processed through Stripe.
You agree not to reproduce, duplicate, copy, sell or exploit any portion of the Service without written permission.
SECTION 3 – PRODUCTS AND SERVICES
All artworks presented on this website are original, one-of-a-kind creations by Joana Castro.
Each artwork exists as a singular physical piece and will not be reproduced or reissued in any form.
Gift cards, limited editions, and commissioned works may also be offered from time to time.
Images are provided for reference. While every effort is made to represent colors, textures, and scale accurately, variations may occur due to lighting conditions, screen settings, and the inherent material qualities of the work.
Availability is subject to confirmation. IQUI reserves the right to withdraw, modify, or discontinue any artwork or offering at any time.
Prices are listed in Euros (€) and include VAT where applicable.
Pricing and availability are subject to confirmation in accordance with Section 3.A.
SECTION 3.A – ORDERS AND PRICE INTEGRITY
The presentation of artworks and pricing on this website constitutes an invitation to enter into a transaction and does not constitute a binding offer.
An order submitted by a collector represents an offer to acquire the artwork. A binding agreement is formed only upon written confirmation issued by IQUI.
Automated acknowledgements of receipt do not constitute acceptance.
While every effort is made to ensure the accuracy and integrity of pricing and availability, IQUI reserves the right to decline or cancel any order prior to confirmation in the event of manifest pricing errors, technical irregularities, system malfunction, unauthorized access, or any interference affecting the integrity of the website.
Where payment has been processed under such circumstances, a full refund will be issued without undue delay.
IQUI reserves the right to correct inaccuracies or omissions at any time in order to preserve the integrity of the transaction.
SECTION 4 – COMMISSIONS
Commissions are available upon request and confirmed in writing.
Each begins with a dialogue about perception, space and light, leading to a singular work created specifically for the collector.
A non-refundable deposit may be required to initiate the process.
Completion timelines are approximate and depend on artistic and material conditions.
All commissioned works remain the intellectual property of the artist, and reproduction rights are not transferred upon purchase.
SECTION 5 – PAYMENTS
Payments made through the website are securely processed via Stripe, which accepts major credit cards and Apple Pay.
All payments are processed by Algoritmo Espacial, Unipessoal Lda., the legal entity responsible for the sale and fulfillment of artworks presented on this website.
Alternative payment methods, including bank transfers and selected digital asset payments such as stablecoins, may be accepted upon request and must be confirmed in writing prior to execution.
Full payment is required prior to shipment of the artwork or release of the associated digital certificate.
Processing of payment does not in itself constitute acceptance of an order. Acceptance occurs only upon written confirmation as set forth in Section 3.A.
Payment information processed through Stripe is encrypted and securely handled by the payment provider. IQUI does not store credit card or financial data.
SECTION 6 – SHIPPING AND DELIVERY
Original artworks
- Each artwork requires preparation time prior to dispatch. Please allow up to seven (7) business days for packing and handling.
- Shipping is provided at no additional cost.
- International shipping is subject to destination availability and applicable regulations. Delivery to certain locations may be restricted due to legal, carrier, or external constraints.
- Once dispatched, a tracking reference will be provided.
- Studio pickup may be available by appointment.
Gift cards
- Gift cards are physical items associated with a connected digital certificate.
- Shipping for gift cards is included.
- Gift cards may be shipped to the purchaser or directly to a designated recipient.
- Once dispatched, a tracking reference will be provided.
- Studio pickup may be available by appointment.
Customs and import duties
- Shipments outside the European Union may be subject to customs duties, import taxes, or handling fees imposed by local authorities. Any such charges are the responsibility of the recipient.
SECTION 7 – RETURNS, EXCHANGES AND DAMAGED WORKS
Returns and Exchanges
- All artworks offered for sale by IQUI are original, one-of-a-kind works.
- Due to their unique and singular nature, artworks are not eligible for return or exchange once the purchase has been formally confirmed.
- Collectors are encouraged to review all available information carefully and to request clarification prior to completing a purchase.
- Nothing in this Section shall affect any mandatory consumer rights under applicable law.
Damaged Works
- If an artwork is delivered in a damaged condition, written notice must be provided within two (2) business days of receipt.
- The notification must include clear photographic documentation of the artwork and all packaging materials as received.
- Claims will be assessed based on the documentation provided. Where damage is confirmed to have occurred during transport or handling prior to delivery, an appropriate resolution will be offered.
SECTION 7.A – GIFT CARDS
IQUI gift cards are physical objects associated with a connected digital certificate.
Gift cards are valid for twelve (12) months from the date of receipt, as confirmed by delivery tracking or pickup confirmation.
Each gift card corresponds to a unique 15 × 15 cm hand-painted canvas and includes an embedded NFC chip linked to its digital certificate.
Gift cards are available with a minimum value of €200.
Gift cards may be applied toward the purchase of any available artwork or commission up to their assigned value. If the selected artwork exceeds the gift card value, the balance may be paid using an accepted payment method.
Gift cards are non-refundable and cannot be exchanged for cash.
In the event of physical loss or damage, the associated digital certificate remains the sole valid record of ownership and balance.
SECTION 8 – AUTHENTICITY AND INTELLECTUAL PROPERTY
Each original artwork includes a dual-layer authenticity verification system:
Physical Layer
- A signed and dated certificate issued by the artist, and an embedded NFC chip for instant verification via smartphone.
Digital Layer
- A permanent certificate stored on the Solana blockchain providing an immutable record of provenance, ownership, and authenticity.
- The NFC chip links directly to the blockchain certificate, creating a secure connection between the physical artwork and its digital proof of authenticity. The chip can be scanned with any NFC-enabled smartphone without requiring special applications.
- If the NFC chip becomes non-functional, the blockchain certificate and signed physical certificate remain valid as proof of authenticity.
When reselling an artwork, contact IQUI to transfer the blockchain certificate to the new owner. The physical certificate should accompany the artwork. Provenance history is permanently maintained on the blockchain.
All intellectual property rights, including copyright and reproduction rights, remain exclusively with Joana Castro, the artist. Purchasing an artwork grants you ownership of the physical object, the right to display and resell the work, and personal photography for documentation and non-commercial social media sharing with proper attribution. Purchasing does NOT grant you copyright, reproduction rights, permission to create prints or copies in any form, commercial use of the artwork image, or rights to create derivative works or use the image on merchandise, publications, or digital platforms beyond the included certificate. Unauthorized reproduction or commercial use is prohibited without express written permission from the artist.
All website content, including artwork images, photographs, text, design elements, and original written descriptions, is protected by copyright law. The Eigengrau Algorithm, as described and implemented on this website, including its application to artwork identification and the associated methodology, is proprietary. Unauthorized reproduction or commercial use of this system is prohibited.
SECTION 8.A – FRAUD, TAMPERING AND COUNTERFEITING
Each original artwork, gift card, or commissioned piece includes physical and digital identifiers confirming authenticity.
Tampering with or altering any authenticity identifiers is strictly prohibited. This includes removing, damaging, cloning, or attempting to reassign the NFC chip or digital certificate to another work, as well as forging or altering physical certificates.
If you suspect that an artwork has been falsified or altered, immediately contact studio@iqui.art, keep the artwork in a stable environment, and preserve all packaging and documentation. We may assist with verification and, if necessary, initiate an independent authentication process.
Any confirmed case of tampering, counterfeiting, or fraudulent use will void all related certificates and may result in cancellation of sale, refusal of future authentication, or legal action.
While we apply advanced security measures to protect authenticity, we cannot be held liable for third-party misuse, fraudulent replication, or digital fraud beyond our control.
SECTION 9 – PRIVACY AND DATA PROTECTION
Your submission of personal information through the store is governed by our Privacy Policy.
We collect and process only the data necessary to complete your order and communicate with you.
We comply fully with the General Data Protection Regulation (GDPR) and do not sell or share data with third parties except when required for payment or shipping.
SECTION 10 – LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Algoritmo Espacial, Unipessoal Lda. shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of this website or the purchase of artworks offered herein.
Nothing in these Terms shall exclude or limit liability where such limitation is not permitted under applicable law, including liability for fraud, gross negligence, or willful misconduct.
Each artwork is a unique, original creation. Variations in texture, surface, or material behavior are inherent to the artistic process and do not constitute defects.
SECTION 11 – TERMINATION
These Terms are effective unless terminated by either party.
We may terminate or suspend access if you fail to comply with these Terms or if fraud, abuse or misuse is suspected.
All obligations incurred prior to termination shall survive termination for all purposes.
SECTION 12 – GOVERNING LAW
These Terms of Service and any agreements for the sale of artworks or related services shall be governed by and construed in accordance with the laws of Portugal.
To the extent permitted by applicable law, any dispute arising out of or in connection with these Terms or any transaction concluded through this website shall be subject to the jurisdiction of the courts of Porto, Portugal.
Nothing in this Section shall affect any mandatory rights granted to consumers under applicable law.
SECTION 13 – ALTERNATIVE DISPUTE RESOLUTION
In the event of a consumer dispute, the consumer may refer the matter to an alternative dispute resolution entity, without prejudice to the right to seek judicial remedy.
